1. Introduction

These Terms and Conditions govern your use of services provided by CLOUD HIVE DC LTD. By accessing our website or purchasing our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.

These Terms apply to all hosting services: Dedicated Servers, VPS, Game Servers, AI/GPU Servers, Storage, and Web Hosting.

2. Definitions

  • Service: Any hosting service or infrastructure provided by CLOUD HIVE DC.
  • Content: Data, files, and applications stored on our services.
  • SLA: Service Level Agreement specifying uptime guarantees.
  • AUP: Rules governing permitted use (Section 8).

3. Service Level Agreement (SLA)

We guarantee the following uptime:

  • Dedicated/VPS: 99.9%
  • Game/AI Servers: 99.5%

SLA Credits: If we fail to meet uptime, you may be eligible for credits (10-50% depending on downtime). Credits must be requested within 30 days.

4. Account Registration

You must provide accurate information and verify your identity when requested. We use automated fraud detection systems. New orders may require identity (ID) or address verification.

5. Billing and Payments

Services are billed in advance. Setup fees are due immediately. We accept Cards, PayPal, Crypto, and SEPA. Late Payments: Services may be suspended after 7 days overdue and terminated after 30 days.
Refunds: 30-day money-back guarantee for new customers (conditions apply).

6. Data Protection

We protect data under UK Data Protection Act 2018 and GDPR. For account data, we are the Controller. For your server content, we are the Processor.

7. Customer Responsibilities

You are responsible for securing your passwords, updating server software, and maintaining backups of your data. You are solely responsible for any content you host.

7. Acceptable Use and Prohibited Activities

7.1. You agree not to use the Services for any unlawful purpose or in any way that interrupts, damages, or impairs the service.

7.2. The following activities are strictly prohibited and will result in immediate termination of your account without refund:

  • Cryptocurrency Mining: Any use of system resources for mining cryptocurrency (e.g., Bitcoin, Ethereum, Monero) is strictly prohibited.
  • Spam and Mass Emailing: Sending unsolicited bulk emails (SPAM) or hosting "spamvertised" sites.
  • Network Abuse: DDoS attacks, port scanning, botnets, or any attempt to penetrate other networks.
  • Illegal Content: Hosting of phishing sites, malware, copyrighted materials (DMCA), or child sexual abuse material (CSAM).

7.3. We reserve the right to audit your usage and request identity verification (KYC) if suspicious activity is detected. Failure to provide ID will result in service suspension.

9. Suspension and Termination

We may suspend services immediately for AUP violations or non-payment. You may terminate services with 30 days notice. Data is deleted 30 days after termination.

10. Limitation of Liability

IMPORTANT LEGAL NOTICE

TO THE MAXIMUM EXTENT PERMITTED BY UK LAW: Our total liability is limited to the amount you paid in the last 12 months. We are not liable for indirect damages or data loss. Services are provided "as is".

11. Consumer Rights

If you are a consumer (not a business), you have rights under the Consumer Rights Act 2015: services must be provided with reasonable care and skill.

12. Intellectual Property

CLOUD HIVE DC LTD retains rights to our infrastructure. You retain rights to your content.

13. Dispute Resolution

Disputes should first be resolved via support ticket. Unresolved disputes are handled via mediation or UK courts.

14. Governing Law

These Terms are governed by the laws of England and Wales.

15. Force Majeure

We are not liable for delays caused by natural disasters, war, or events beyond reasonable control.

16. Changes to Terms

We may update these Terms. Continued use of services constitutes acceptance.
